The Dickies® 2009 American Worker of the Year® Contest and Sweepstakes Official Rules
NO PURCHASE NECESSARY. PURCHASE DOES NOT IMPROVE CHANCE OF WINNING.
1. Eligibility: The Dickies® 2009 American Worker of the Year® Contest (the “Promotion”) is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older and located in the U.S. at the time of entry. Void elsewhere and where prohibited by law. Winning Nominees must also be legal residents of the 50 United States or the District of Colombia, 18 years of age or older, and must be employed or self-employed at the time they are selected. Nominators and Voters must be 13 years or older. Employees, contractors, directors and officers of Williamson-Dickie Mfg. Co. (“Sponsor”), Site Systems ("Judging Agency") and their respective parent, subsidiary and affiliated companies, distributors and licensees, and the advertising, fulfillment, judging and promotion agencies involved in the development and administration of the Promotion (collectively, “Promotion Parties”), and their immediate family members (parent, child, sibling and spouse of each) and those living in the same households of each are not eligible to enter or win. Any Nominee who has ever been convicted of a felony will not be eligible. Other eligibility requirements and conditions of participation are set forth below in these official rules for the Promotion (“Official Rules”).
2. Entry Period: The Promotion begins at 12:00 a.m. Central Time ("CT") on 5/1/09 and ends at 11:59 p.m. CT on 6/30/09 (the "Entry Period").
3. How to Enter the Contest and Sweepstakes: The participant who submits the entry is referred to herein as the "Nominator" and the person who the entry is about is referred to herein as the "Nominee" (even if the Nominator and the Nominee is the same person). Enter through any one of the following methods:
a. Online Entry. Go to www.WorkerOfTheYear.com and click on the link on the home page to locate the online official contest entry form. Follow the on-screen directions to upload your photograph, complete all required fields and click submit to enter. LIMIT ONE (1) PHOTO ENTRY PER NOMINEE PER ONLINE ENTRY.
b. Mail-in Entry. To enter by mail, go to a participating outlet and pick up an official entry form or go to www.WorkerOfTheYear.com and click on the link on the home page to locate the official contest mail-in entry form and print out the form. Clearly and legibly complete all the required fields, attach a photo and mail to: Dickies 2009 American Worker of the Year Contest, PO Box 5332, Culver City, CA 90231-5332. Mail-in entries must be postmarked by 6/30/09 and received by 7/7/09. LIMIT ONE (1) PHOTO ENTRY PER NOMINEE PER OUTER ENVELOPE. MAIL-IN ENTRIES WILL NOT BE ELIGIBLE FOR WEEKLY PRIZES NOR BE POSTED ONLINE.
You may nominate yourself, and you may enter more than once, but each entry must be for a different Nominee and submitted separately. LIMIT ONE (1) CONTEST ENTRY PER NOMINEE.
Each Voter is automatically entered into the sweepstakes. LIMIT ONE (1) SWEEPSTAKES ENTRY PER PERSON/E-MAIL ADDRESS/WEEKLY ENTRY PERIOD.
4. Conditions of Submission
a. Essay Questions. You must answer all required essay questions on the entry form. Limit 100 words per question Nominee must be the subject of the Essay. Answers must be Nominator's own original work, be true and verifiable, may not contain profanities or obscenities nor depict Sponsor unfavorably, and must be consistent with the image of Sponsor. Illegible entries will be void. Essay must be in English. Sponsor reserves the right in its sole discretion to disqualify any entry that does not comply with these requirements or these Official Rules.
b. Photograph. The photograph submitted must be taken by the Nominator. Nominee must be shown wearing Dickies apparel. Photograph may be in color or black-and-white and if submitted online must be in JPEG format and a maximum size of 2 megabytes per photograph. Mail-in photograph should be no larger than 5 x 7. Slides, transparencies, videotapes and DVDs are not eligible. Any photograph which Sponsor, in its sole opinion, deems to be inappropriate for publication will not be considered, and the corresponding Nominator will be disqualified. By submitting an entry each Nominator represents and warrants that: (i) his/her photograph is the sole and original creation of the Nominator and has not been copied in whole or in part from any other work; (ii) the entry does not violate or infringe any copyright, trademark/tradename, or other proprietary right of any person (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity; (iii) the entry is the sole and exclusive property of the Nominator; and (iv) the subject(s) and/or persons depicted in any of the photographs have given written consent to its submission into the Promotion and use as contemplated by these Official Rules. Please do not submit photographs that contain depictions of other third party artistic works, copyrights, trademarks/tradenames, logos, or similar brand identifying marks.
By entering, each Nominator (and Nominator's parent or legal guardian if Nominator is a minor) warrants and represents that entry is his/her own original work, has not been previously published, that Nominator owns or otherwise controls all of the rights to entry materials and each Nominator (and Nominator's parent or legal guardian if Nominator is a minor) unconditionally assigns and transfers to Sponsor all rights, title, interest and claim, which it now has or may in the future have to the entries or any element(s) thereof.
Sponsor may, but shall be under no obligation to do so, post any entries on www.workeroftheyear.com. Posting of an entry is not an indication that the entry has won a prize or is otherwise eligible for a prize. Submission of an entry grants Sponsor the right to use, publish, adapt, edit and/or modify such entry in any way, in whole or in part, and to use such entry alone or in combination with other works, as solely determined by Sponsor, in commerce and trade and in any and all media now known or hereafter discovered, worldwide, including but not limited to the www.workeroftheyear.com web site, without limitation or compensation to the Nominator and without right of notice, review or approval of any such use of the entry. Submission of an entry further constitutes the Nominator's (and Nominator's parent or legal guardian if Nominator is a minor) consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the entry, including but not limited to all intellectual property rights. By entering, each Nominator (and Nominator's parent or legal guardian if Nominator is a minor) further warrants and represents that he/she has received all rights which may be necessary from any person or entity depicted in the photograph to grant this assignment and transfer of rights. Prior to awarding any prize, the Nominee must agree to the terms of these Official Rules and to sign and return any required Affidavit, Liability and Publicity Releases.
5. Voting/Judging: Entries will be voted upon and/or judged as provided below. Judging will be i conducted by a panel of experts under the supervision of Judging Agency, an independent judging organization whose decisions are final in all matters relating to the Promotion. There will be three rounds of voting/judging:
a. Weekly Worker Voting: In this round, the Nominee that receives the highest number of eligible votes within the weekly Voting Period (as defined below) will be selected as the potential Weekly Dickies 2009 American Worker of the Year®. In the event of a tie, the entries will be judged by the Judging Agency on the basis of the criteria stated in rule #5b. The voting round will be run as follows:
1. Voting Period: Voting begins at 12:00 a.m. Central Time ("CT") on 5/01/09 and ends at 11:59 p.m. CT on 7/4/09 (the "Voting Period"). Each weekly voting period starts at 12:00am CT Sunday, and ends at 11:59 pm CT on Saturday, except the first week will begin on Friday 5/1/09 and end on Saturday 5/9/09.
2. How to Vote: During the Voting Period, individuals may vote on a Nominee by Online Vote: Go to www.WorkerOfTheYear.com and click on the link on the home page to locate the online official voting form. Follow the on-screen directions, complete all required fields and click submit to vote. Votes will be reset each week. All non-winning entries from previous weeks will be included in subsequent weekly voting.
Limit one (1) vote per person/e-mail address/nominee/week. Votes by automatic, programmed or like methods will be disqualified. Improper, incomplete, mutilated and illegible votes will be disqualified. No photocopied votes accepted. In the event of a dispute regarding the identity of the person submitting a vote, votes will be declared made by the voter’s name submitted at time of vote. Each vote counts as an entry in the Voter Sweepstakes.
Each Weekly Worker of the Week will automatically be entered into the Regional Finalist Judging.
b. Regional Finalist Judging. All eligible contest entries will be judged on the basis of the criteria upon the photo’s composition (40%), the Essays’ sincerity (40%) and the extent to which the Nominee represents the spirit of the American worker (20%). Sponsor reserves the right to conduct a telephone interview with a minimum of the two highest scoring entrants within each Region. The entrant that performs best in the interview will be chosen as the Regional Finalist. Regional Finalists will be determined on or about 7/24/09. Regional Finalists (Nominees) must be willing to participate in an interview (to be recorded) by Sponsor. The geographical boundaries of each Region are within Sponsor’s discretion.
c. Worker of the Year Judging: The Regional Finalist entries will be judged on the basis of the criteria stated in rule # 5b (70%) and the interview (30%) and one (1) Worker of The Year Winner will be selected with the highest cumulative scores ("Worker of the Year"). The Worker of the Year winner will be determined on or about 9/21/09.
In the event of a tie during any round of judging, the tied entries will be re-judged on the basis of the extent to which the Nominee represents the spirit of the American worker.
6. Voter Sweepstakes Random Drawing and Odds:
On or about July 15, 2009, the Judging Agency shall conduct a random drawing (“Voter Random Drawing”) from among all eligible votes received as described in rule # 5 during the Voting Period. Odds of winning the Voter Random Drawing will depend upon the number of eligible votes received during the Voting Period.
For each of the nine weeks of Online Voting, a Weekly Voter Prize will be awarded. The 9 weekly Voter Prize drawings shall be conducted among all eligible Online Votes received during the applicable entry period by the Judging Agency for the applicable weekly entry periods as follows: Week 1:May 1-9, Week 2:May 10-16, Week 3: May 17-23, Week 4: May 24-30, Week 5: May 31-June 6, Week 6: June 7-13, Week 7: June 14-20, Week 8: June 21-27 and Week 9: June 28-July 4, 2009. Online Entries from the previous week will not roll-over into subsequent weekly Voter Prize drawings.
On or about October 5, 2009, One (1) Voter Grand Prize drawing will be conducted among all eligible Online Votes specific to the Grand Prize Winner Nominee during the promotion period.
7. Prizes and Approximate Retail Values (“ARV”):
a. Contest Prizes: One (1) Grand Prize (to be provided to the Dickies 2009 American Worker of the Year): One (1) Dickies 2009 American Worker of the Year Jacket (ARV: $100), a trip for two to the 2009 Dickies 500 NASCAR Nextel Cup Race on 11/8/09 for a chance to win $1,000,000 at the Grand Prize event and a trip for two to the Professional Bull Riders finals on 10/30/09. The trips consists of roundtrip coach air transportation for two (each trip up to a maximum cost of $2,700) from a major airport near winner's residence (as determined by Sponsor) to the location of the events (Fort Worth, Texas and Las Vegas, Nevada), hotel accommodations for 3-days/2-nights (one room, double occupancy) at each venue (ARV: $6,820). All other expenses not specifically mentioned herein, including, but not limited to, transportation, additional meals, gas, insurance, tolls, beverages, activities, incidental hotel expenses, taxes and/or gratuities are the sole responsibility of each winner and his/her travel companion. In addition, if the Grand Prize winner does not win the $1,000,000 in the Grand Prize Event, as described below, winner will receive a check in the amount of $50,000.00 Total approximate retail value of Grand Prize package is $1,009,620. Five (5) Regional Finalist Prizes: Each Regional Finalist will receive $10,000 in the form of a check, a trip for two to the Dickies 2009 American Worker of the Year® award ceremony held at the Thomas and Mack Center in Las Vegas. The trip consists of roundtrip coach air transportation for two (up to a maximum cost of $2,700) from a major airport near winner's residence (as determined by Sponsor) to Las Vegas, Nevada, hotel accommodations for 2-days/1-night at the Mandalay Bay Hotel in Las Vegas (one room, double occupancy). Travel dates currently scheduled to be 10/30/09 - 10/31/09 (ARV: $3,052), one (1) Dickies 2009 American Worker of the Year® Jacket (ARV: $100). Total ARV of Regional Finalist Prize is $15,852. Nine (9) Worker of the Week Prizes: Each weekly winner will receive One (1) Dickies 2009 American Worker of the Year Jacket (ARV: $100) and Dickies apparel (ARV: $250).
b. Grand Prize Event: On or before November 7, 2009 (date to be determined by Sponsor), the Worker of the Year will randomly select one (1) number, without repetition, from the range 01-12, which will be used to identify his/her selected driver (“Selected Chase Driver”). Each of the twelve (12) numbers will identify one of the twelve (12) Chase drivers in the Dickies 500 NASCAR Nextel Cup Race, scheduled for November 8, 2009 at the Texas Motor Speedway, by the drivers' reported NASCAR starting position, regardless of the actual position in which the driver starts the race (e.g., if the Worker of the Year randomly picks the number five, then the Worker of the Year’s Selected Driver is the driver whose reported NASCAR starting position is fifth). The process for random selection shall be determined by the Sponsor. If the Selected Driver randomly selected by the Worker of the Year is the official winner of the Dickies 500 Race on November 8, 2009, by NASCAR's official ruling, the Worker of the Year will be awarded $1,000,000, to be paid as an annuity in equal installments of $20,000 per year for 50 years without interest. The Sponsor may, in its sole discretion, modify the above Grand Prize giveaway procedure. By accepting the annuity, the Worker of the Year Grand Prize winner agrees to release the Sponsor and surety from all liability and responsibility for payments of the prize and acknowledge that such liability and responsibility shall rest only with the annuity company from which the annuity is purchased for the winner.
c. Voter Sweepstakes Prizes: One (1) Voter Grand Prize: A trip for two to the Dickies 2009 American Worker of the Year® award ceremony held at the Thomas and Mack Center in Las Vegas. The trip consists of roundtrip coach air transportation for two (up to a maximum cost of $2,700) from a major airport near winner's residence (as determined by Sponsor) to Las Vegas, Nevada, hotel accommodations for 2-days/1-night at the Mandalay Bay Hotel in Las Vegas (one room, double occupancy). Travel dates currently scheduled to be 10/30/09 - 10/31/09 (ARV: $3,052). Nine (9) Weekly Voter Prizes: Dickies apparel (ARV: $250). Total Voter Sweepstakes Prizes value: $8,002. No substitution, cash redemption or transfer of prizes is permitted except at Sponsor’s sole discretion. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute a prize of equal or greater value. All federal, state and local taxes, and all other costs associated with acceptance or use of the prizes, are the sole responsibility of the winner. Arrangements for delivery of prizes will be performed after winner validation. LIMIT ONE (1) WEEKLY VOTER PRIZE AND ONE VOTER GRAND PRIZE PER PERSON/EMAIL ADDRESS.
The total approximate value of Contest Prizes is $1,092,030. The total approximate value of Sweepstakes Prizes is $8,002.
Grand prize, Regional Finalist and Worker of the Week Prizes are awarded to the Nominee. In the event Nominee fails to satisfy all requirements set forth in these rules, Sponsor is under no obligation to award the corresponding prize to the Nominee. Prizes will be delivered once all winners have been verified. LIMIT ONE PRIZE PER PERSON/EMAIL ADDRESS. If any prize is unclaimed, if any prize correspondence or prize is returned as undeliverable, or if a winner is found ineligible or not in compliance with these Official Rules, the prize will be forfeited and an alternate winner may be selected, at Sponsor's option. The prize components of the Dickies apparel included within the Weekly Worker and Voter Prize is at the sole discretion of Sponsor. If prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute a prize of equal or greater value. All federal, state and local taxes, and all other costs associated with acceptance or use of the prizes, are the sole responsibility of the winners.
8. Conditions: All potential winners will each be notified by telephone, regular mail or overnight mail, and potential winners (or potential winners' parent or legal guardian if potential winner is a minor) will be required to complete, sign and return an affidavit of eligibility, a liability release, and where lawful, a publicity release within a stated amount of time. If affidavits/releases are not received by the date stated on the notification, or if any notification is returned as non-deliverable, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, or does not return such other releases as deemed necessary by Sponsor, the potential winner will be disqualified and at Sponsor's discretion, an alternative potential winner may be selected. Promotion Parties assume no responsibility for lost, late, misdirected, stolen, illegible, inaccurate, damaged or incomplete entries or submissions, non-delivered or postage due mail, failure or unavailability of electronic equipment, communications or internet connections, or other errors, failures or malfunctions of any kind. Entries by automatic, programmed or like methods will be disqualified. Improper, incomplete, mutilated and illegible entries will be disqualified. No photocopied entries accepted. If multiple entries are received from any person/e-mail address for the same Nominee, only the first such entry received will be eligible for entry. All entries become the property of the Sponsor and will not be returned. Finalists may be subject to a background investigation, including but not limited to criminal record information. Prizes will be awarded only to an address within the United States. This Promotion is subject to all federal, state and local laws. By participating, Nominators agree to be bound by these Official Rules and the decisions of the Judging Agency. If, in Judging Agency’s sole opinion, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Judging Agency reserves the right to modify or terminate the Contest in a manner deemed reasonable by the Judging Agency, at the Judging Agency’s sole discretion. Sponsor reserves the right to disqualify any individual who tampers with the entry process or the www.WorkerOfTheYear.com website or acts in a disruptive manner. This Promotion is offered only in the United States and is governed by the laws of the state of Texas. By entering, Nominators consent to the jurisdiction and venue of the federal, state and local courts located in Fort Worth, Texas.
9. Additional Conditions for the Grand and Regional Finalist Prize Winners and Voter Grand Prize Winner: Travel prize winners must be able to travel on dates listed or as designated by Sponsor or prize will be forfeited in its entirety and an alternate winner may be selected, at Sponsor’s option. Dates of trip, location, travel arrangements and accommodations are at Sponsor's sole discretion, and are subject to availability and change. All other expenses not specifically mentioned herein, including, but not limited to, additional meals, gas, parking fees, insurance, tolls, beverages, activities, incidental hotel expenses, taxes and/or gratuities are the sole responsibility of each winner and his/her travel companion. Winner and travel companion must travel on the same itinerary, and must comply with all security requirements. If the winner is a minor in his/her state of residence, he/she must be accompanied by a parent/legal guardian. Winner’s travel companion must be over 18 and must sign and return a liability/publicity release as a condition of travel. If any event is cancelled after travel is booked, only travel portion of prize will be awarded and no compensation will be given for event portion of the prize. Actual value of prizes including travel will depend on point of departure and airfare fluctuations. Any difference between stated value and actual value will not be awarded. If Winner does not meet age requirement for car rental or is unable to meet any other requirement, Winner forfeits car rental portion of the prize.
11. Release: Except where prohibited, by accepting prize, winner (and winner’s parent or legal guardian if winner is a minor) grants permission for Sponsor and its agents to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.
12. Winners' List Requests: For names of prize winners, mail a self-addressed, stamped #10 envelope to be received by 09/30/09 to: Winners' List Request, Dickies 2009 American Worker of the Year Contest, PO Box 5442 Culver City, CA 90231-5442.
13. Sponsor: The Promotion is sponsored by Williamson-Dickie Mfg. Co., Fort Worth, TX.
14. Administrator/Judging Agency: The Promotion is administered and judged by Site Systems, 5855 Green Valley Circle, Suite 108, Culver City, California 90230.
